Prohibited Conduct
If you are an InteliChart affiliate, you may use the materials available on InteliChart.com freely under the following terms:
- This website is the source of truth for current versions of the materials. You can keep copies of the materials for yourself, but do not distribute them. Instead, link others directly to the materials made available on InteliChart.com.
- You own what you develop using the materials. InteliChart owns the materials, as well as any InteliChart provided improvements to or learnings based on the materials, such as enhancements made by InteliChart to our testing tools or documentation. Any materials on InteliChart.com may become part of the materials for anyone to use without any obligation or notice to you.
- You are responsible for your products and/or services and how they interact with InteliChart software. You are also responsible for complying with all applicable laws, including not infringing on InteliChart’s or others’ intellectual property rights. Some interoperability technology may require an InteliChart a license for additional functionality or build additional workflows, so where possible please help our mutual customers avoid surprises by working closely with them and directing them to InteliChart with any questions related to our software.
- If you want to use InteliChart’s trademarks, please contact InteliChart directly at InteliChart.com for permission in advance.
- You agree to indemnify, hold harmless and defend InteliChart, its subsidiaries, and all its and their employees, officers, directors, contractors, and other personnel, from and against any claim (defined below) that in any way arises out of or relates to any of your products or services that use or rely on the materials. “Claim” means all claims, demands, investigations, inquiries, and actions, and all liabilities, damages, fines, and expenses arising out of or relating thereto, including without limitation settlement costs and attorneys’ fees.
- The interfaces and APIs available on InteliChart represent a subset of the interoperability technology for FHIR to support the access, exchange, and use of electronic health information and other data. Other value-added APIs and services are available on different terms through different processes and programs.

Receiving a fee, including but not limited to a license fee, royalty, or revenue-sharing arrangement.

Accessing of InteliChart’s API’s means that you have entered into a legal and enforceable agreement and that you explicitly will abide by the following:

You will not interfere with any operational processes, server, network, or systems associated with InteliChart to create a risk of patient harm or disrupt users’ ability to use InteliChart’s API’s/software

You will not attempt to defeat, bypass, remove, deactivate, or otherwise circumvent any firewall, encryption, security, authentication routines, or software protection mechanisms in the
open.InteliChart.com APIs or InteliChart on FHIR, including any such mechanism used to restrict or control the functionality

You are solely responsible for all liabilities and consequences, including performance issues, fines assessed against You by the government and loss of reimbursement, that arise from Your, API Users’, or Your patients' use of or inability to use any Product. Among other things, this means You are responsible for the following, all to the extent permitted by applicable law:
- Vetting each API User and Product to assure yourself of the accuracy, completeness, and appropriateness prior to interaction with InteliChart APIs.
- Ensuring each API User appropriately registers.
- Testing and authorizing all Products that you choose to connect to InteliChart API’s (including testing each Product in Your non-production environments after Updates, or functionality or configurations changes
- Ensuring that the correct APIs are being called in the right sequence and the that the timing between API calls are appropriate
- InteliChart is not responsible for configuration decisions (including workflow modifications and the use and mapping or appropriate terminologies) during the use of InteliChart APIs except where explicitly stated
- Confirming the accuracy and relevance of information made available to or from InteliChart APIs
- Ensuring API Users and Products meet Your organization’s security and privacy requirements, and appropriate audit trails are maintained
- Assessing, planning for, and mitigating potential impacts of planned or unplanned downtimes
